§1

GENERAL PROVISIONS

  1. These Terms and Conditions set out the conditions for the Pre-order organized through the Store www.pajaksport.pl.

  2. The Organizer of the Pre-order is PAJAK SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, entered into the Register of Entrepreneurs by the District Court in Bielsko-Biała, VIII Economic Department of the National Court Register under KRS number: 001201233, place of business and address for service: ul. Cmentarna 3, 43-300 Bielsko-Biała, NIP: 9372775937, REGON: 543142053, e-mail address: sklep@pajaksport.pl, phone number: +48 334876654.

  3. Before purchasing a Pre-order Product, the Participant is obliged to read the content of these Terms and Conditions and to comply with its provisions.

  4. The Pre-order is conducted in the online store pajaksport.pl

§2

DEFINITIONS

  1. TERMS AND CONDITIONS – these Pre-order Terms and Conditions.

  2. STORE – the Organizer's online store operating at www.pajaksport.pl.

  3. PRE-ORDER – content presented on the Store's website constitutes an invitation for Participants to submit offers, referring to Products in Pre-order and enabling placing an Order for them before their premiere.

  4. PRE-ORDER PRODUCT – a future Product, marked on the Store's website with the term "pre-order," for which the Order Processing Time is specified in its description.

  5. ORDER – a declaration of will by the Pre-order Participant constituting an offer to conclude a sales agreement for the Pre-order Product with the Organizer, submitted via the Order Form.

  6. ORDER PROCESSING TIME – the number of days, which includes the time to complete the Order and its delivery by the carrier to the place indicated by the Pre-order Participant in the Order Form.

  7. ORDER FORM – a form available on the website www.pajaksport.pl enabling the placement of an Order in the Store.

  8. ORGANIZER – PAJAK SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, entered into the Register of Entrepreneurs by the District Court in Bielsko-Biała, VIII Economic Department of the National Court Register under KRS number: 001201233, place of business and address for service: ul.   9. PRE-ORDER PARTICIPANT – any customer of the Store who expresses a desire to participate in the Pre-order and purchases Pre-order Products

 §3

PRE-ORDER RULES

  1. The Pre-order covers Products marked on the Store's website with the term "pre-order."

  2. Participation in the Pre-order is voluntary, and the Participant has the right to participate in the Pre-order (during its validity period) multiple times, provided that the conditions of these Terms and Conditions are met each time.

  3. Orders for Pre-order Products can be placed via the Store's website.

  4. Orders placed by Participants within the Pre-order are processed according to the order in which they are placed. The Organizer reserves the right to cancel Orders placed by Participants within the Pre-order in the event the limit of a given Product is exhausted.

  5. In the event of cancellation of an Order, as referred to in point 3 of this paragraph, the Participant will immediately receive a refund for the purchased Product. The refund is made by the same method that the Participant used to pay for the Product.

  6. The provisions of the Store's terms and conditions apply to sales agreements for Pre-order Products in matters not regulated by these Terms and Conditions.

  7. The Order Processing Time indicated in the description of the Pre-order Product is only an approximate deadline, is informative in nature, and may change (be extended or shortened) due to reasons beyond the Organizer's control.

  8.  Orders placed within the Pre-order are fulfilled only after the Participant's payment has been credited to the Organizer's bank account.

  §4

DISCLAIMER REGARDING THE FINAL PRODUCT VERSION

  1. The Organizer reserves the right to introduce minor modifications to the product compared to the version presented on the website; however, any such changes will be made solely to improve the final product.

  2. These adjustments may result from ongoing winter-condition testing, aimed at enhancing the product’s functionality, durability, or overall user comfort.

  3. Any potential differences will not impact the product's general character, purpose, or declared technical specifications.

  §5

COMPLAINTS

  1. Any complaints regarding the Pre-order process may be submitted in writing to the Organizer's address with the note "Pre-order - complaint" or to the e-mail address: sklep@pajaksport.pl

  2. The right to submit a complaint is only granted to Pre-order Participants.

  3. The submission should include the reason for the complaint and the contact details of the person submitting it.

  4. A response to the complaint will be provided within 14 days from the moment it is submitted to the correspondence address or e-mail address indicated by the person submitting the complaint.

 §6

PERSONAL DATA

  1. The Organizer is the administrator of the personal data of the Pre-order Participants. Personal data provided by the Pre-order Participant to the Organizer will be processed for the purpose of executing the sales agreement concluded between the Organizer and the Participant, the subject of which is the Pre-order Product, in accordance with the provisions of this paragraph and the Store's privacy policy 

  2. Providing personal data by the Participant is voluntary, but failure to provide it prevents the purchase of Pre-order Products in the Store.

  3. The data subject has the right to access the content of their personal data and the right to rectification, erasure, restriction of processing, the right to data portability, the right to object, and the right to withdraw consent at any time without affecting the lawfulness of processing carried out based on consent before its withdrawal. 

4. Legal grounds for the Participant's request:

a. access to data – Art. 15 GDPR,
b. rectification of data – Art. 16 GDPR,
c. erasure of data (the so-called right to be forgotten) – Art. 17 GDPR,
d. restriction of processing – Art. 18 GDPR,
e. data portability – Art. 20 GDPR,
f. objection – Art. 21 GDPR,

g. Withdrawal of consent – Art. 7 ust. 3 GDPR.

5. To exercise the rights referred to in point 4, a relevant e-mail can be sent to the address: sklep@pajaksport.pl

6. Suppose the Participant exercises a right resulting from the above rights. In that case, the Organizer shall comply with the request or refuse to comply with it immediately, but no later than within one month of receiving it. However, if, due to the complexity of the request or the number of requests, the Organizer will not be able to comply with the request within one month, it will comply with it within the next two months, informing the Participant beforehand, within one month of receiving the request, about the intended extension of the deadline and its reasons.

7. If it is found that the processing of personal data violates the provisions of the GDPR, the data subject has the right to lodge a complaint with the President of the Office for Personal Data Protection.

  §7

FINAL PROVISIONS

  1. A brief description of the Pre-order rules may be found on the Organizer's website. All such content is for informational purposes only.

  2. In matters not regulated by these Terms and Conditions, the provisions of the Store's terms and conditions , the Civil Code, the Act on Consumer Rights, and other relevant provisions of Polish law shall apply.

  3. If any provision of these Terms and Conditions is invalid, the remaining provisions shall remain in force and shall continue to bind the Organizer and the Participant.

  4. Any disputes arising from the Pre-order between the Organizer and the Participant will be resolved primarily through negotiations, with the intention of amicable settlement of the dispute. However, if this is not possible or is unsatisfactory for either party, disputes will be resolved by the competent common court.
